My husband and grandson were going to California for a family emergency...we took the van over to Lube & Tune and asked for an oil change (before the trip so the van will be in good shape for the trip)....I might add at this point that my husband is handicapped, and my grandson is 8 years old. ....and he was traveling thru the desert heat....well, anyway....the oil plug was not put back in correctly and the oil was leaking from the plug...about 65 miles from home, the oil ran all the way out of the van...in the middle of the desert...with the closest garage 20 miles away....in 110 degree heat.....well the motor threw a rod thru the block of the motor....so my husband and grandson were stranded in the 110 degree heat, for over 4 hours..... Well, I called the lube shop and told them what happened and they laughed at me, cussed me for being such a stupid B -----, and hung up on me....according to my attorney, unless I had a mechanic check the van before and after the oil change...I do not have a leg to stand on...... Does anyone know what we can do?

Makes you feel helpless doesn't it? Well your not. Your fucking lawyer lied to you too. If that is the lawyer you normally use for legal matters get a new one. This was a matter of poor business relations. I would contact the Attorney General of the state in which you had the vechicle serviced. They can help you for free. Also the one I bet you will get the most help from is the Better Business Bureau. They offer you legal representation for free if you have a case. If not I believe you can at least file complaint againest them to have on record and make them look bad.

Just reread your post. Your lawyer lied to you. You did not have to have it checked before and after oil service. Did you have it checked when it broke down and did they say that was what caused your engine to fail? I am a pre-law student and if it was my grandparents stranded in the heat I know I would just be unstopable in a court of law. Nobody deserves what you got. All my advice is free of charge. File a complaint with the bureau of automotive repair. They will log the complaint and they will also tell you if there are any other complaints with that company.
